Anna DWI Attorney

The US-75 Corridor

Anna’s population has more than doubled in a few years, and most of its residents commute on US-75, which runs along the west side of town. That makes the highway the center of many Anna DWI cases. A stop on US-75 late at night may be made by an Anna police officer or by a state trooper, and the trooper’s video, records, and testing procedures come from a different agency than the local police.

Anna sits near the northern edge of Collin County. A stop a few miles farther north, past the county line, becomes a Grayson County case with a different courthouse and prosecutor. For arrests in Anna itself, the case is prosecuted by the Collin County District Attorney’s Office and heard at the Russell A. Steindam Courts Building, 2100 Bloomdale Road, McKinney, about 15 minutes south.

Highway Stops Are Different

  • Speed and lane changes. Highway stops often begin with a speed or lane-change violation. The video should show it.
  • The shoulder. Field sobriety tests on a highway shoulder, with traffic passing at 70 mph, are given in exactly the conditions the training warns against.
  • Breath or blood. Highway arrests often lead to a blood warrant late at night. The warrant has to be supported by specific facts, and the blood has to be drawn and handled properly.

The First Two Weeks

  1. Bond. A magistrate sets bond and conditions, which may require an ignition interlock device.
  2. The license deadline. Request an ALR hearing within 15 days of the arrest notice, or your license is suspended automatically on the 40th day.
  3. Preserve the evidence. Request every agency’s video and records early.

Penalties

A first DWI is a Class B misdemeanor with 72 hours to 180 days in jail and a fine up to $2,000; at 0.15 or more it becomes a Class A misdemeanor. A conviction adds a state traffic fine of $3,000 or more. Deferred adjudication is available for many first offenses, except at 0.15 or above or for commercial license holders, a common issue for drivers who commute or work along US-75.

A Former Officer and Prosecutor on Your Side

Al Rowland is a former police officer certified to administer Standardized Field Sobriety Tests and a former prosecutor in Colorado. He reviews an Anna arrest from the roadside to the courtroom: what the video shows, how the tests were run, how the breath or blood evidence was handled, and how the State is likely to build its case.

Frequently Asked Questions

A state trooper arrested me, not Anna police. Does that change anything?

The charge and the court are the same, but the evidence comes from a different agency, and your lawyer needs to request it from the right place quickly.

I have a commercial driver’s license. What’s at risk?

A DWI conviction, even in your personal vehicle, generally disqualifies a CDL for at least a year, and deferred adjudication isn’t available to CDL holders.

Can I keep driving to work?

If a suspension takes effect, you may qualify for an occupational driver’s license, often with an ignition interlock.
